PHYSICIAN SERVICES - Family Practice

1. Physician shall skillfully perform and document those duties customarily performed by Family Practice physicians, which shall include, but not be limited to:

  • History taking and appropriate physical examinations.Formulation of differential diagnoses.
  • Ordering of appropriate diagnostic tests.Compliance with contract terms of various managed care products.Prescription of medication, and or procedures as is medically or surgically appropriate.Follow-up care as is appropriate.
  • Maintenance of appropriate, legible, and timely written patient records, which shall at all times be suitable for use by successor physicians, and strict adherence to Health Center's policies regarding the custody of patient charts.Completion of properly submitted information requests.
  • Supervision of individuals who participate in the care of patients or the rendering of services to Medicare patients for the purpose of providing high quality patient care.
  • Fostering the development of managerial skills by individuals who participate in the care of patients or the rendering of services to patients.Participation in professional education programs which will maintain and advance professional and staff patient-care skills and programs which will educate patients and their families.
  • Participation in activities directed towards improving the professional care rendered by Physician and Health Center, including such peer and utilization review and other programs as Health Center shall designate from time to time during the term of this Agreement

2. Medical Staff Membership and Privileges: Physician will obtain and maintain active medical staff privileges at one or more hospital, in accordance with Physician's medical specialty, as reasonably designed in writing by the Health Center.

 

3. Professional Licenses: As a condition of initial and continued employment, Physician will obtain and maintain, at all times during the term of this Agreement, a full and unrestricted license to practice medicine in the state of California. Health Center will reimburse Physician for medical license fees incurred during the term of this Agreement.HealthCenter's obligation to pay these fees will be reduced pro rata in the event of early termination of this Agreement.

 

4. As a condition of initial and continued employment, Physician will obtain and maintain an unrestricted Drug Enforcement Administration license to prescribe controlled substances at all times during his employment with the Clinic.

 

5. Reporting Adverse Actions:

   A. Physician will notify Clinic in writing within two (2) working days of any proposed adverse action or other adverse action, whether final or not, threatened or taken by any hospital, institution, insurance company, health maintenance organization, preferred provider organization, governmental agency, medical review board, professional review organization or any other third party against Physician.

    B. Physician will notify Clinic in writing within two (2) working days of being notified that any report concerning him has been filed with the Medical Board of California, any other State's medical board or the National Practitioner Data Bank.

    C. Physician will notify Clinic in writing within two (2) working days any restriction, limitation, suspension or revocation of any license related to the practice of medicine or prescribing of medications in any state, including but not limited to the State ofCalifornia

 

6. Reporting Legal Actions:

   A. Physician will notify Clinic in writing within two (2) working days of being served with a summons, complaint, written claim, or other document alleging professional negligence, or other injury arising from his medical practice, or any other liability notwithstanding whether the action occurred before or during Physician's employment by the Clinic.

    B. Physician shall notify Clinic in writing within two (2) working days of any event which raises a reasonable probability that it will result in a legal claim or action against the Physician relating in any way to the practice of medicine.

    C. Physician will notify Clinic in writing within two (2) working days of any arrest, indictment or conviction of Physician for other than a misdemeanor motor vehicle license infraction.

 

7. Treatment of Patients: Nothing herein requires Physician to refer any patients to Clinic or any of its affiliates during the term of this Agreement. Physician shall render all health care services in accordance with his professional judgment and all ethical standards.

 

8. Assignment: During the term of this Agreement and for a reasonable amount of time thereafter, Physician hereby assigns to Clinic the right to bill and collect for all professional services rendered to Clinic patients.
